Are you paying super correctly and on time?

Super Guarantee mistakes are expensive. Pay late — even by a day — or miss a contractor who counts as an employee for super, and you can be hit with the Super Guarantee Charge, which is not tax-deductible. We check the common failure points.

Questions

What is the Super Guarantee Charge (SGC)?
If you pay super late or short, you may have to lodge an SGC statement and pay the charge — which includes the shortfall, interest and an administration fee, and is not tax-deductible. It's significantly more expensive than paying on time.
Do contractors get super?
Sometimes. A contractor paid wholly or principally for their labour can be a “deemed employee” for super under s12(3) of the SGAA, even with an ABN and a contract. We flag where that risk sits.
What's the current SG rate?
The rate is set by legislation and has been stepping up over recent years. We verify the current rate against the ATO before advising rather than quoting from memory.
